The National Framework for NHS Continuing Healthcare was issued on 26th June 2007 and is aimed at establishing consistent eligibility criteria for NHS funded care. It is intended that this should come into effect on 1st October 2007.
This document puts the emphasis for eligibility firmly on the persons need. Amongst other things it states that:

  • Where a person demonstrates a primary health need their care should be funded by the NHS.
  • The nature, complexity, intensity and unpredictability of the needs should be examined.
  • Eligibility should not be based on
    • The setting for care
    • The ability of the care provider to manage care.
    • The use or not of NHS employed staff to provide care.
    • The need for /presence of specialist staff in care delivery.

This new framework has also proposed that England in line with Wales and Scotland should from 1st October 2007 replace the current 3 tiers of Registered Nursing care Contributions to just one although the amount is still to be published.

As part of this new framework the Department of Health has also published a tool designed to support decision makers in the application of the national policy on eligibility for NHS continuing care.
